Welcome to GoldStar Home Repairs LLC. These Master Terms & Conditions of Service ("Agreement") govern all home improvement, handyman, repair, commercial maintenance, and property upkeep services provided by GoldStar Home Repairs LLC ("Contractor") to the property owner, property manager, or authorized client ("Customer"). By approving any estimate, digital quote via Jobber, or formal invoice, the Customer explicitly agrees to be legally bound by the terms outlined below.

1. SCOPE OF WORK & UPFRONT PRICING

All services performed by the Contractor shall be strictly limited to the written flat-rate line items detailed within the digitally accepted Jobber Estimate or Invoice (the "Scope of Work").

1. Direct Upfront Pricing: Contractor operates strictly on direct, upfront pricing. The accepted quote is the binding rate for the defined Scope of Work.

2. No Verbal Modifications: Field technicians lack the authority to modify the Scope of Work verbally. Any request for extra, alternative, or expanded tasks must be officially compiled into a formal digital Change Order via Jobber and approved by the Customer before additional work will commence.

3. Subcontracting: Contractor reserves the right to retain qualified, licensed, and insured subcontractors or specialized craftsmen at Contractor's sole discretion.


2. FINANCIAL TERMS, MINIMUM FEES, MARKUP & CANCELLATIONS

Customer agrees to make payment in full immediately upon completion of the outlined Scope of Work unless a progressive milestone payment schedule is explicitly detailed in the Jobber estimate.

1. Minimum Trip/Service Fee: Contractor enforces a baseline Minimum Service Fee of $150.00 for all scheduled service calls to cover mobilization, fuel, and initial diagnostic dispatch.

2. Material Procurement & Markup: Raw materials, fixtures, and supplies acquired by Contractor on behalf of Customer are subject to a standard 30% material markup to cover procurement overhead, sourcing time, transport, and delivery to the job site.

3. Payment Methods: Contractor accepts major credit cards, debit cards, and bank transfers executed securely through the Jobber Client Hub, as well as Venmo (on-site) and pre-authorized company checks.

4. Late Fees: Invoices remaining unpaid forty-eight (48) hours past project completion shall be deemed delinquent. Delinquent accounts are subject to an immediate administrative fee of $35.00, plus an accumulating late finance charge of 1.5% per month (18% per annum) on any remaining outstanding balance until paid in full.

5. Cancellation Policy: If a Customer cancels a scheduled appointment within twenty-four (24) hours of the scheduled arrival window, Customer remains legally liable to reimburse Contractor for all non-refundable or special-order materials purchased, alongside an immediate $75.00 late cancellation administrative fee.


3. ACCESS TO PROPERTY, UTILITIES & ON-SITE INTERFERENCES

Workspace must be safely accessible, properly prepared, and entirely dedicated to Contractor's personnel during service windows.

1. Utility Authorization: Customer grants Contractor explicit, unhindered permission to utilize the property's electrical power outlets and water supply at no operational cost. These utilities are strictly required to operate power tools, charging systems, and cleanup equipment. Contractor is exempt from any liability relating to minor variances on Customer's monthly utility bills.

2. Physical Entry: Customer must ensure an adult authorized representative (aged 18 or older) is present, or provide clear digital gate codes, lockbox combinations, or structural keys.

3. Wasted Trip & Rescheduling Fee: If Contractor arrives at the scheduled property and is unable to execute work due to locked access, uncoordinated conflicting contractors, or an unprepared work zone, a mandatory $149.00 Return Fee will be automatically assessed. This fee must be paid in full before rescheduling.


4. PRE-EXISTING CONDITIONS & DAMAGE WAIVERS

1. Concealed Defects: Contractor bears zero legal liability for pre-existing structural decay, dry rot, mold infestations, subterranean termite damage, hidden water leaks, degraded internal plumbing, or non-code-compliant electrical wiring discovered behind walls, flooring, or ceilings during execution. If underlying defects are unmasked, work will cease instantly until a remedial Change Order is approved.

2. Personal Property Cleared: Customer is exclusively responsible for relocating valuable objects, artwork, electronics, and furniture away from the designated work zone prior to arrival. Contractor rejects liability for accidental cosmetic damage to items left exposed within or adjacent to active working areas.


5. MATERIALS, WARRANTIES & CUSTOMER-SUPPLIED GOODS

1. 1-Year Craftsmanship Warranty: Labor is guaranteed against installation defects for 1 year from project completion. Excludes normal wear and tear, house settling, storm/moisture damage, and materials/fixtures (covered solely by manufacturer warranties).

2. Customer-Supplied Goods: If Customer requests Contractor to install fixtures, parts, or materials purchased independently by Customer (e.g., Amazon, liquidators, retail home centers), Contractor provides absolutely no warranty on those components. Contractor bears zero liability for product failures, manufacturing defects, early degradation, or fluid leaks stemming from customer-supplied goods. All labor required to troubleshoot or reinstall replacement parts will be billed as a new service.


6. DIGITAL DOCUMENTATION & MEDIA RELEASE

1. Time-Stamped Evidence: Customer grants Contractor full authorization to capture time-stamped digital photographs and videos of work zones before, during, and after task completion as legal proof of physical property condition.

2. Marketing Release: Customer agrees Contractor may utilize transformed job photos for commercial marketing, portfolio presentations, and digital media without compensation. Private consumer details (street names, portraits) will be cropped or blurred.


7. CONDUCT & WORKPLACE SAFETY

Contractor enforces a zero-tolerance policy regarding verbal hostility, screaming, profiling, physical intimidation, or harassment. Work zones must remain free of unsecured domestic animals, active biohazards, or uncontained minors. Contractor retains the unilateral right to terminate the contract and exit the property immediately if safety terms are violated, with Customer liable for 100% of recorded labor hours and purchased materials up to the moment of evacuation.


8. COLLECTION COSTS, INDEMNIFICATION & NORTH CAROLINA LAW

1. Collection Overhead: Customer agrees to reimburse Contractor for all collection costs, court fees, administrative filing fees, and reasonable attorneys' fees incurred while recovering delinquent funds.

2. Limitation of Liability: Contractor's total financial liability for any claims, errors, structural accidents, or breaches of contract shall be strictly capped at a maximum amount not to exceed the gross monetary amount actually paid by Customer to Contractor under this specific contract.

3. Jurisdiction: This Agreement shall be governed strictly by the laws of the State of North Carolina. Exclusive legal venue for any litigation resides solely within the courts of New Hanover County, North Carolina.

1. SCOPE OF WORK & COMPENSATION

• Services: Contractor agrees to perform the flat-rate work outlined in Estimate/Invoice #________ (the "Scope of Work"). Any extra work requested will require a written digital Change Order.

• Payment & Pricing: Customer agrees to pay the total agreed-upon amount upon completion of work via Jobber, Venmo, or card. Minimum service call fee is $150.00. Materials purchased by Contractor carry a standard 30% procurement markup.

• Delinquent Accounts: Payments unreceived after forty-eight (48) hours are subject to a $35 administrative fee plus 1.5% monthly interest (18% per annum) until paid in full.


2. ACCESS TO PROPERTY & UTILITIES

• Access & Power: Customer grants Contractor full access to the site during scheduled windows and provides continuous access to structural electrical power outlets and water supply at no cost to Contractor.

• Return Fee: If Contractor arrives and is unable to safely access or perform work due to locked entries, uncoordinated contractors, or an unprepared area, a $100.00 Return Fee will be assessed prior to rescheduling.


3. LIMITATION OF LIABILITY & PRE-EXISTING CONDITIONS

• Hidden Defects: Contractor is not liable for pre-existing rot, water damage, mold, termite decay, or non-code plumbing/electrical discovered inside walls, ceilings, or under floors. Work will pause until a Change Order is executed.

• Personal Property: Customer must clear the work zone of valuables, furniture, and electronics. Contractor is not liable for damage to items left in or adjacent to the work area.

• Financial Liability Cap: Contractor's maximum financial liability for any claims or structural damages shall not exceed the total gross amount paid by the Customer for this specific contract.


4. MATERIALS AND WARRANTY

• 1-Year Craftsmanship Warranty: Labor is guaranteed against installation defects for 1 year from project completion. Excludes normal wear and tear, house settling, storm/moisture damage, and materials/fixtures (covered solely by manufacturer warranties).

• Customer-Supplied Materials: Contractor provides NO warranty on materials or fixtures supplied directly by the Customer. Subsequent labor to fix or replace failing customer-supplied parts will incur standard labor charges.


5. JURISDICTION & GOVERNING LAW

This agreement is governed by the laws of the State of North Carolina. Exclusive venue for any dispute resolution resides in New Hanover County, NC.
